1. General Terms

By purchasing a trailer or product from Tuff Trailers Ltd, you agree to the Terms and Conditions set out below. These terms apply to all sales, orders and deliveries, whether made online, in person, or through authorised distributors.

Tuff Trailers Ltd reserves the right to update, amend or modify these Terms and Conditions at any time without prior notice. The most current version will always be available on our website.

2. Warranty Terms

Specific trailers supplied by Tuff Trailers Ltd carry a 5-year structural guarantee. Components (excluding those listed below) include a 12-month parts warranty from the date of purchase. Labour costs are not covered under this warranty.

Bearing failure is excluded, as bearing performance depends on the owner’s maintenance and greasing diligence. Tuff Trailers Ltd does not warrant galvanising, which is specifically excluded from all coverage.

Consumable items such as bulbs, tyres and other wear parts are excluded. Consequential loss or damage resulting from trailer use or failure of any component is not covered.

The warranty is void if a defect is caused by tampering, misuse, neglect, modification, alteration, off-road use, overloading, accident, or normal wear and tear. All trailers must be kept in roadworthy condition to WOF standards for legal use on New Zealand roads.

Warranty claims must be made by delivering the trailer to Tuff Trailers Ltd, Tauranga, for inspection and assessment. All costs and risks associated with transport to and from our premises are the owner’s responsibility. Proof of purchase is required for all warranty claims.

3. Limitation of Liability

In no event shall Tuff Trailers Ltd be liable for any indirect, special, incidental or consequential damages, including but not limited to loss of use, data, business, or profits. Liability is limited strictly to the replacement or repair of the warranted product or component.

4. Disclaimer

Due to continual product development and improvement, Tuff Trailers Ltd reserves the right to change product specifications, materials, pricing, and claims at any time without prior notice.

5. Delivery Conditions

Tuff Trailers Ltd accepts no responsibility for any damages or losses that may occur during the delivery of products. Delivery may be completed by independent contractors or carriers, in which case Tuff Trailers Ltd accepts no liability for damage or delay.

All deliveries are made at the customer’s risk, and it is the customer’s responsibility to inspect goods upon receipt. Delivery costs and times vary depending on location, trailer size, and third-party carrier terms.

6. Payment Terms

Full payment is required before collection or delivery unless otherwise agreed in writing. Prices are in New Zealand dollars (NZD) and include GST unless stated otherwise.

Payments can be made by approved methods listed on our website or invoice. Orders will not be processed until payment is confirmed.

7. Finance Terms

Finance is available through MTF Finance First Avenue. Applications can be made online and are subject to the lender’s approval process.
Finance terms, interest rates, and repayment options are determined by MTF Finance First Avenue under their own lending criteria.
Tuff Trailers Ltd is not a finance provider and assumes no responsibility for finance approvals or terms.

8. Returns & Cancellations

All trailer sales are final unless required by law. Custom-built or modified trailers cannot be cancelled once production has commenced.
Parts and accessories may be returned within 7 days of purchase only if unused, in original packaging, and accompanied by proof of purchase. Return shipping costs are the responsibility of the buyer.

9. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of New Zealand. Any disputes shall be subject to the exclusive jurisdiction of the New Zealand courts.

10. Acceptance of Terms

By purchasing a product, placing an order, or submitting payment through the website or directly with Tuff Trailers Ltd, you acknowledge that you have read, understood, and agreed to these Terms and Conditions in full.
